ChatWisp, Inc. ("ChatWisp", "we", "us") operates an AI-first forms and survey platform. This Privacy Policy explains what we collect, how we use it, and the choices you have. It covers two kinds of people:

  • Creators — people who sign up for a ChatWisp account and build forms.
  • Respondents — people who answer a form a creator has shared.

For respondent answers submitted through a creator's form, that creator is the "data controller" and ChatWisp acts as a "data processor" on their behalf. If you answered a form and want your responses changed or deleted, contact the organization that sent you the form; we will assist them as their processor.

Information we collect

From creators (account holders):

Voice, recordings, and AI

ChatWisp forms can be conducted by an AI assistant over voice or chat. When voice is used, audio may be captured and converted to text by a speech-to-text service so the assistant can understand the answer. The assistant's replies may be generated as audio by a text-to-speech service. Conversations are processed by AI models to conduct the interview, extract structured answers, and (for creators) synthesize insights. ChatWisp's AI assistants are designed to disclose that they are AI, and the respondent experience presents a consent step before a recorded voice conversation begins.

How we use information

We use the information to: provide and operate the service; conduct AI interviews and capture responses; generate analytics and insights for creators; authenticate users and secure accounts; process payments; provide support; monitor, debug, and improve the product; detect and prevent abuse or fraud; and comply with legal obligations. We do not sell personal information, and we do not use respondents' answers to train third-party AI models for their own purposes.

Service providers and sub-processors

We share data only with vendors that help us run the service, under contracts that limit their use of it:

Cookies and analytics

We use essential cookies and similar technologies to keep you signed in and to operate the service. If we add product analytics, we will describe them here and honor applicable consent requirements.

Data retention

We keep account and form data for as long as your account is active. Respondent responses are retained for the creator who owns the form until they delete the form, the responses, or their account, subject to our backup cycle and any legal retention obligations. We delete or de-identify data when it is no longer needed for the purposes above.

Your rights and choices

Depending on where you live (including under the GDPR and CCPA/CPRA), you may have the right to access, correct, delete, port, or restrict the processing of your personal information, and to object to certain processing. To exercise these rights:

International transfers

We operate from the United States and may process data in the U.S. and other countries. Where required, we rely on appropriate safeguards (such as Standard Contractual Clauses) for cross-border transfers.

Children

ChatWisp is not directed to children. We do not knowingly collect personal information from anyone under 16 (or the minimum age in your jurisdiction). If you believe a child has provided us information, contact us and we will delete it.

Security

We use industry-standard safeguards — encryption in transit, access controls, and server-side handling of third-party API keys (keys are never exposed to the browser). No method of transmission or storage is perfectly secure, but we work to protect your information and to notify affected users of incidents as required by law.

Changes to this policy

We may update this policy as the product evolves. We will revise the "Last updated" date above and, for material changes, take additional steps to notify you where appropriate.
